Getting Evidence Admitted (or Excluded) at Trial

Litigating a case without basic knowledge of the rules of evidence is like assembling an airplane in a pitch-black room. You may be driving divots into the metal — but once you turn the light on — you discover a worthless vessel that will not hold up, let alone take you where you want to go.

If you are part of a pending lawsuit, and you are —

  • Representing yourself in the case; or
  • An attorney with minimal or no litigation experience; and
  • You are not familiar with how to evaluate what evidence is admissible in court; then

You are operating in the dark. And you may find that your evidence is not admissible in court — or lacks a legal foundation — and your case may never get off the ground.

Don't harm your case by waiting (until it is too late) to evaluate and resolve any evidentiary issues in your case. Instead, study and apply the principles in Introduction to Evidence Law, together with the rules of evidence in your jurisdiction.

Litigation attorneys Neer Lerner and Elliott Malone introduce you to general evidence concepts so that you can:

  • Carefully assess your case's strengths and weaknesses long before the day of trial;

Common Evidence Law Principles and Federal Rules of Civil Procedure

Every jurisdiction in the United States operates under its own set of evidence rules that determine what is — or is not — admissible in court. In federal courts, the Federal Rules of Evidence (FRE) apply.

The vast majority of states' evidence rules mirror the FRE, but there may be important differences in your state. That’s why this video series focuses on the FRE and on common trial evidence issues.

Introduction to Evidence Law will: 

  • Lay groundwork for the most common evidence rules used in courts of law;
  • Break down and explain essential portions of the FRE line by line and word by word — using real-world, understandable examples — so you can evaluate how it pertains to the evidence; and
  • Discuss some key areas where states’ evidence rules tend to deviate from the FRE so you can be aware of potential differences

Strategies to Determine if Evidence Is Admissible or Inadmissible

Evidence — whether it is an exhibit, testimony, photo, or whatever — is only useful if you can actually get it admitted into evidence at trial so the jury can consider it. If it's not admissible — or you don't have the proper legal argument to prove its validity — the jury will most likely never see it.

To help you determine if your evidence is admissible, the video tutorials will

  • Define and explain key legal terms in simple language — and cut through the impenetrable fog of "Legalese" in evidence law;
  • Show how evidence presented at trial can be rejected for one purpose but allowed for another — with many examples to help you identify the difference; and

The Test for Relevance

Relevance is a crucial factor the court considers in determining whether evidence should be excluded at trial.  The videos will explore how to determine if your evidence is relevant— so you can increase the likelihood that you could present it to the jury.

You'll discover things like:

  • What are the determining factors of relevance in the eyes of the court;
  • Seven reasons a judge might exclude your evidence — even if it is relevant to your case; and
  • How judges evaluate when to exclude evidence as “prejudicial”

Hearsay Rules

Thanks to Hollywood, hearsay is one of the least understood concepts of evidence law in the United States. Most people don't realize that the term “hearsay” covers a much broader range of statements than just words. In fact, many (even most) statements made in everyday life would fit the definition of hearsay and be inadmissible in court — unless they fall under an exclusion or exception to the hearsay rule.

Here are three things that you should take away after viewing this section:

  1. A workable definition of what hearsay means;
  2. The ability to quickly identify a hearsay issue so you can make a timely objection at trial; and
  3. Common exceptions and exclusions to the hearsay rule—that you should know well before trial.

Plus, Introduction to Evidence Law will break hearsay into bite-sized, digestible pieces to help you understand how hearsay issues come up at trial — with real-to-life examples that are easy to grasp.

Character Evidence

In everyday life, people use information about a person's character and past behavior to judge them as a person. In court, however, you may be frustrated to learn that this type of “propensity” evidence is usually inadmissible — subject to some important exceptions. The key — as elsewhere in evidence law — is to understand which exceptions apply (and when).

You'll learn:

  • The reason why a person's previous actions or “skeletons in the closet” are generally inadmissible in a court of law — with clear examples you will quickly understand;
  • When character evidence can be admissible — with side-by-side comparisons — so you can identify what may make certain evidence admissible vs. inadmissible; and
  • Other important considerations when seeking to use the character, habits, and past actions of your opponent at trial.

When Trial Witnesses Are Allowed to Express Opinions

Believe it or not, most opinion testimony by lay witnesses (non-experts) is not permitted. As a general rule, opinion testimony by law witnesses is inadmissible at trial. However, there are some very important exceptions you must know if your case is going to trial.

You'll learn:

  • Which opinions of a lay witness are generally admissible vs. inadmissible;
  • How to better identify improper questions or inadmissible opinion testimony at trial; and
  • Examples of generally admissible vs. inadmissible opinion testimony — so you can develop a clear understanding of the difference.

If you want to build a persuasive case at trial — and get your most important evidence admitted (and exclude your opponent’s most damaging evidence) — you must understand the basics of evidence law. You definitely don't want to "wing" it.

Easy tasty way to support digestive health
PSA- You need more fiber. I've been using these prebiotic fiber gummies for a while now, and overall I've had a very positive experience. The Citrus Berry Splash flavor is genuinely enjoyable, which makes them much easier to take consistently than some other fiber supplements I've tried. I also love the convenience I keep the bottle on my coffee table and have them after dinner when I watch TV. I've noticed that they help support regularity when taken consistently, and I like knowing that they contain prebiotic fiber to help nourish beneficial gut bacteria. For me, these gummies work best as part of an ongoing digestive health routine rather than as a quick solution when I'm already feeling backed up. In those situations, I personally find fiber powders to be a bit more effective. However, that's not really the purpose of these gummies—they're designed to help maintain digestive health and regularity over time, and I think they do that well. The gummies tend to stick together in the bottle, especially once I've gotten about halfway through it. I've found that storing the bottle upside down helps prevent them from clumping too much and makes them easier to grab. Overall, these are a great option if you're looking for a tasty, convenient fiber supplement that's easy to stick with long term. They've helped me maintain regularity, taste great, and are much easier to incorporate into a busy schedule than many other fiber products. I would definitely purchase them again.

Delicious and easy to chew probiotic gummies that also add fiber to your diet!
i just received this package of probiotic fiber gummies and can assure you that they taste terrific! The container is easy to open and includes an internal seal both to assure freshness and the safety of the product. These are individual gummies that are easy to chew and taste yummy! One flavor is citrusy and another has a berry flavor. Chewing them was not at all difficult and I did not feel like I ended up with lots of residual product stuck in my teeth. Each serving of 3 gummies provides 6 grams of fiber which is an additional benefit to the probiotics! The recommended dose is 3-6 gummies per day. As well as being flavorful and easy to chew, the addition of fiber is a great benefit for most people’s diets! I am a healthy woman of “a certain age” as the French say. I don’t have specific health problems that I know of but I am trying in general to maintain a healthy lifestyle. That was my goal in acquiring this product. This is the first day I have eaten and enjoyed these probiotic gummies. Of course I have not experienced any health benefits yet but my initial experience eating these soft gummies has been extremely positive! If you are interested in adding probiotics or fiber to your diet, I encourage you to purchase these inexpensive, delicious and easy to chew gummies!

Tastes Great!
I’ve tried a lot of fiber supplements over the years, and these are honestly one of the easiest ones to stick with consistently. The biggest thing for me is that they actually taste good. The Citrus Berry Splash flavor is pleasant without being overly sweet or having that weird artificial vitamin aftertaste some gummies have. They’re soft and easy to chew too. Some fiber gummies can be oddly hard or stick to your teeth, but these have a good texture and are easy to take daily. What I really appreciate is the convenience. It’s so much easier for me to remember gummies than mixing powders into drinks all the time. I can just take them quickly in the morning or after dinner and be done with it. After using them consistently, I’ve noticed they help keep things more regular without feeling harsh or causing the kind of stomach discomfort some fiber products can. They feel gentler compared to a lot of other options I’ve tried. The large bottle is another plus. With 126 gummies, it lasts quite a while, so even though the upfront cost might seem a little high, I think the value is pretty reasonable for how long they last. I also like that they’re a simple way to add a little extra support to my routine, especially on days where my diet probably isn’t perfect. Overall, easy to take, good flavor, gentle on the stomach, and something I’ll continue buying.

Yummy and great alternative!
I’m a regular user of Benefiber powder. I add it to my protein shakes in the morning - but there are days I don’t have time to make a shake. I needed an alternative source for fiber and decided to try these. PROS: - Tasty! I really like the fruity flavor. It’s not too strong of a flavor and it leaves a decent aftertaste. - They’re easy to chew, swallow, and go down. - Container comes with 126 gummies which will definitely last a while. - Freshness is good. I’ve opened and shut the container several times over the last couple of weeks and the remaining gummies stay soft. - They work to keep me regular, which is nice because I don’t always have to have the powder. CONS: - They make my husband gassy and bloated. He isn’t used to daily fiber, so maybe it’s just going to take some getting used to.

Great flavor, great value!
I was truly impressed with these chewable vitamins! First, they have a delightful flavor, possibly a mix of orange and raspberry, and they taste pleasantly sweet. The texture resembles that of fruit snacks rather than gummies, as they did stick to my teeth slightly, but not for long. You receive a good supply of 42 servings (with 3 chewables per serving). I did find that they contain a bit more sugar than I expected (2g), and I wish they included at least some amount of soluble fiber. However, with 6g of dietary fiber, they complement my usual supplement well. Overall, this is a great value for the money and an impressive supplement.
